dc.description.abstractThe society’s need to ensure health security is dramatically increasing. Therefore, it seeks to find ways and means that enhance the health aspect. One of the medical and scientific developments in this field is the possibility of transplanting organs from a living or dead person to another alive. Yet, these operations are challenging particularly in its legal regulation. One of its regulations regarding the unclear position of the dead person (consent or refusal), the law authorized the relatives, orderly and exclusively, to declare their position on the transplant of organs from their dead relative to another person
